Fives Soccer Centres Terms and Conditions

These Terms and Conditions govern your use of Fives Soccer Centres facilities, services, events and activities. “We”, “us” and “our” refer to Fives Leeds Ltd, trading as Fives Soccer Centres. “You” and “the hirer” refer to the person or organisation making the booking. 1. Payments and Bookings

  1. The hirer is responsible for payment of all fees and any other charges relating to the booking.
  2. The hirer may not assign or sub-let the right to use the facilities and must use the facility only for the agreed purpose.
  3. A booking is only confirmed once all relevant registration forms have been completed and full payment (or the required deposit) has been received and we have issued written confirmation.
  4. Invoices must be paid within 14 days of receipt. Failure to do so may result in your booking being cancelled.
  5. We may review prices from time to time and will give customers a minimum of 30 days' notice of any change affecting an existing booking.
  6. A non-refundable deposit of 25% of the total balance is required to secure an event booking. The remaining balance must be paid in full at least 30 days before the event. Failure to do so may result in cancellation at the manager's discretion.
  7. For activities and parties, full payment is required at the time of booking unless the centre General Manager agrees otherwise in writing. Each birthday party includes a set number of children; additional children are charged at the published per-child rate.
  8. Functions booked within 30 days of the function date must be paid in full at the time of booking.
  9. Where children are not existing members of Fives Soccer Centres, the parent or guardian must provide relevant medical information as part of registration, together with emergency contact details (mobile phone and email).
  10. The hirer is responsible for the cost of any damage caused (accidental or deliberate) by event or activity attendees and participants. Repair or replacement costs will be invoiced and are payable within 15 days. If we instruct a debt collection agent to recover sums owed, the hirer will be charged the reasonable fees of that agent.

2. Cancellations and Refunds

  1. Bookings cancelled with less than 72 hours' notice will be charged in full.
  2. Social bookings cancelled with more than 72 hours' notice will receive a full refund.
  3. Where more than 72 hours' notice is given, a booking may be moved once to another day within 7 days of the original date.
  4. For block bookings (10 weeks), one cancellation within the 10-week period is permitted free of charge. Further cancellations within the period will be charged in full.
  5. If we cancel a booking (for example because of weather or facility issues), you will receive a full refund or, at your option, a rearranged session at no additional cost.
  6. Nothing in this section affects your statutory rights as a consumer, including any rights under the Consumer Rights Act 2015.

3. Catering

  1. All food and refreshments are provided by our nominated caterer in all buildings, unless otherwise agreed in writing.
  2. Where the centre does not provide catering, packaged food may be brought to the centre with the prior written consent of the General Manager. The parent or hirer must provide food allergen information in advance.
  3. We accept no responsibility for food brought onto the premises by the parent, hirer or child, except to the extent that any loss is caused by our negligence.
  4. A cleaning surcharge may apply where outside catering is brought into the centre.
  5. At events with a bar service, the bar will close 30 minutes before the function finish time. Drinks not finished by the event end time will be removed. Anyone attempting to bring food or alcohol from outside the premises may be removed from the event and refused re-entry.

4. Rules and Regulations of Use (General)

  1. We seek to maintain high standards across our facilities and expect all users and hirers to contribute to this.
  2. The hirer must ensure that attendees and participants show consideration towards local residents and other site users.
  3. All areas must be left clean, tidy and free from damage.
  4. Appropriate clothing must be worn for all activities.
  5. Due to high demand, we cannot always guarantee immediate access to all parts of the facility.
  6. The hirer is liable for any reasonable additional costs incurred by us if the event or activity overruns.
  7. Broadcast and streaming of activities is subject to Section 13 (Filming, Streaming and CCTV).
  8. Any accident, injury or damage must be reported to the Duty Manager immediately.
  9. You must only park in designated parking places.
  10. Personal photography or video recording at the centre by spectators or participants must be reported to reception.
  11. The hirer may not offer an activity similar to one provided by Fives Soccer Centres without prior written permission.
  12. Set-up and take-down of equipment must take place within the hire time.
  13. Additional terms or restrictions may apply to bookings.
  14. Certain items must not be brought onto the premises without written permission.
  15. The centre holds a Public Entertainment Licence.
  16. Certain prohibited activities are not permitted on site.
  17. We reserve the right to enter any part of the facility at any reasonable time.
  18. We may re-allocate unused parts of the facility.
  19. All users and hirers must comply with these terms and behave considerately.

5. Additional Rules: One-off Hires and Club Block Bookings

  1. Your booking is only confirmed when you receive written confirmation from the centre.
  2. Before your first session you must supply coaching, insurance and affiliation details.
  3. The hirer must ensure suitably qualified persons are in attendance at all times.
  4. Our colleagues are not authorised to accept responsibility for the safekeeping of money or goods.

6. Additional Rules: Events

  1. You are responsible for ensuring that the events manager has all relevant information.
  2. Final catering numbers must be confirmed at least one week in advance.

7. Additional Rules: Changing Rooms

  1. Children under the age of 8 may change in the changing room of their accompanying parent or adult.
  2. Items left in lockers at the end of the day will be removed.
  3. Lost property is generally retained for four weeks.
  4. Schools must supervise their pupils at all times.

8. Additional Rules: Activity Camps and Party Bookings

  1. Parents must collect children promptly if notified.
  2. Children should arrive 15 minutes before the start.
  3. Parents must sign children into the activity camp.
  4. Children must follow instructions at all times.
  5. Children must be suitably clothed.
  6. Children must use the appropriate changing rooms.
  7. Final catering numbers must be confirmed seven working days before the party.

9. Security

  1. Ticketed or public events may require SIA-qualified security.

10. Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud or any other liability that cannot lawfully be excluded.

  1. We accept no responsibility for loss or damage unless caused by our negligence.
  2. Our total liability is limited to the fees paid for the booking.
  3. We are not responsible for non-receipt of event information unless caused by negligence.
  4. No third party has rights under these terms.
  5. We may revise these terms from time to time.
  6. Facilities and services vary between venues.
  7. We may ask any person to leave an event for unacceptable conduct.

11. Health and Safety (including Emergency Procedures)

  1. The hirer must provide evidence of public liability insurance.
  2. Harmful or flammable substances may not be brought onsite without permission.
  3. Electrical equipment must be PAT tested.
  4. Set-up plans and method statements may be required.
  5. No banners or posters may be placed onsite without approval.
  6. Fire exits must not be obstructed.
  7. No gas canisters or open flames are permitted.
  8. Children under 8 must be supervised.
  9. Young people under 16 are not permitted after 8:00pm unless accompanied.
  10. We will provide a qualified first aider onsite.
  11. Hirers must follow emergency procedures.
  12. Accidents or incidents must be reported immediately.
  13. Hirers must comply with health and safety regulations.

12. Safeguarding

Clubs and organisations must provide safeguarding policies, safeguarding officer details and DBS evidence for coaches and instructors.

13. Filming, Streaming and CCTV

CCTV

CCTV operates throughout the centre for safety, security and crime prevention purposes.

General venue filming

Wide-angle filming may take place for operational, training and promotional purposes.

Game and activity filming

Filming, streaming, replay and clip generation form part of the services provided by us and our platform partners.

Who provides consent for a booking

  1. Parents or guardians booking directly provide consent for their own child.
  2. Coaches, schools or organisers booking on behalf of groups confirm that appropriate consents have been obtained.
  3. Where consents are not confirmed, the session will be treated as private.

Public viewing of games is consent-gated

Games are only publicly viewable where all required consents are in place.

Sharing by individuals within the booking group

Participants sharing footage externally are responsible for ensuring appropriate consent.

Spectators

Spectators are informed via signage that filming occurs.

Footage ownership and onward use

Footage captured at the centre belongs to the centre.

Player tracking and statistics

Player tracking and statistics are opt-in on a per-player basis.

Withdrawing consent

Consent may be withdrawn at any time.

14. Data Protection and Privacy

  1. We process personal data in accordance with UK GDPR and the Data Protection Act 2018.
  2. Please notify us if your personal details change.

15. Law and Jurisdiction

  1. These terms are governed by the laws of England and Wales.
  2. Invalid provisions will be severed without affecting the remaining provisions.

16. Comments and Feedback

  1. We welcome feedback about our events and activities.
  2. Formal complaints should be sent in writing to the centre General Manager.
